In compliance with the duty of information contained in article 10 of Act 34/2002 dated 11th July, of Services of the Information and Electronic Commerce Society, the following data are reflected below: the company holding the web domain is the Fernández-Cruz Foundation (hereinafter referred to as the Fernández-Cruz Foundation), with domicile for this purpose in Madrid, Calle Profesor Martin Lagos s/n with Tax ID number: G-28935377 Date of incorporation 3 May 1984, under number 3488 of Order of its protocol, registered in the “Registro de Fundaciones Docentes Privadas de Madrid” of the Ministry of Education and Science – “dirección provincial”-, on April 1, 1985, its Statutes have been adapted to Law 30/1994 dated 24th November, which new text was presented in the Register of Foundations of the Community of Madrid on November 26, 1996. The access and/or use of this site of the Fernández-Cruz Foundation attributes the condition of USER, who accepts, from it access and / or use, the General Conditions of Use reflected herein. The aforementioned Conditions will apply independently of the General Conditions of Contract that in their case are obligatory.


STAYAPPLIVE provides access to multiple information, services, programs or data (hereinafter "the contents") from the Internet belonging to the Fernandez-Cruz Foundation or its licensors to which the USER has access. The USER assumes responsibility for the use of the portal. This responsibility extends to the registry that is necessary to access certain services or contents.

In this registry, the USER will be responsible for providing truthful and lawful information. As a consequence of such registration, the USER may be provided with a password for which he or she will be responsible, undertaking to make diligent and confidential use of this. The USER commits to make appropriate use of the content and services (such as chat services, discussion forums or newsgroups) that Fernandez-Cruz Foundation offers through its portal and with enunciative but Non-limiting, not to use them for (i) any activity which is unlawful, ilicit or contrary to good faith and public order; (ii) disseminating content or propaganda of racist, xenophobic, pornographic- ilegal, apologic of terrorism or violating human rights; (iii) to use the site in any manner that could damage the physical and logical systems of Fernandez-Cruz Foundation, it suppliers and third parties, not to introduce onto or spread on the Internet any computer virus or other physical or software system liable to cause such damage as is described above; (iv) try to access, where appropriate, use the email accounts of other users and modify or manipulate their messages. Fernandez-Cruz Foundation reserves the right to withdraw all comments and contributions that violate the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that attack youth or childhood, Order or public safety or which, in its opinion, are not suitable for publication. In any case, the Fernández-Cruz Foundation will not be responsible for the opinions expressed by users through forums, chats, or other participation tools.


The Fernández-Cruz Foundation complies with the guidelines of Organic Law 15/1999 dated 13th December on the Protection of Personal Data, “Real Decreto 1720/2007” dated 21st December, which approves the Regulations for the development of the Organic Law and other regulations in force at any time, and ensures that the user's personal data is correctly used and processed. To this end, it shall inform the USER of the existence and acceptance of the specific conditions for treatment of their data in each case along with each formula collecting personal data, in the services that the USER may request from the Fernández-Cruz Foundation, informing the user of the responsibility for the file created, the address of the person responsible, the possibility of making use of their rights of access, rectification, cancellation or opposition, the purpose of the treatment and any communication of data to third party, where applicable.

The Fernandez-Cruz Foundation is furthermore making known hereby that it complies with Act 34/2002 dated 11th July, on Services of the Information Society and Electronic Commerce and shall request their consent for processing their electronic mail for commercial purposes in each moment.


The Fernandez-Cruz Foundation, alone or as grantee, retains ownership of all the intellectual and industrial property rights of its website, as well as of the elements contained within (explicitly stated as images, sound, audio, video, software or texts; trademarks or logotypes, colour combinations, structure and design, choice of materials used, computer programmes needed for their operation, access and use, etc.), ownership of Fernandez-Cruz Foundation or its licensees.

All rights are reserved. In pursuance of the provisions in Articles 8 and 32.1, second paragraph, of the Intellectual Copyright Act, it is expressly forbidden to reproduce, distribute and disseminate publicity, including the making available modality of all or part of the contents of the webpage for commercial purposes, in any format and by any technical means, without the authorisation of the Fernandez-Cruz Foundation. The USER agrees to respect the intellectual and industrial property rights pertaining to Fernandez-Cruz Foundation. You can view the items of the site and even print, copy and store them in your computer hard drive or in any other physical medium provided that is purely and exclusively for your personal and private use. The USER must refrain form deleting, altering or manipulating any protective device or security system installed in the Fernandez-Cruz Foundation pages.


The Fernandez-Cruz Foundation cannot be responsible in any case for damages or harm of any kind caused for information purposes of mistakes or gaps in the contents, lack of portal availability or the transmission of malicious or harmful viruses in spite of having adopted all necessary technological measures to avoid it.


The Fernandez-Cruz Foundation reserves the right of making modifications without previous warning considered appropriate for its site, being able to change, suppress or add the contents and services that are offered the way in which these are presented or located in its site.


In the case of STAYAPPLIVE having links or hyperlinks towards other Internet sites, the Fernandez-Cruz Foundation shall not exert any kind of control over those sites and contents. In no case shall the Fernandez-Cruz Foundation assume any responsibility for the contents of any link belonging to an outside website, nor shall it guarantee the technical availability, quality, reliability, accuracy, scope, veracity, validity and constitutionality of any material or information contained in any of the hyperlinks or other Internet sites.

Equally, the inclusion of these external links shall not imply any kind of association, merger or involvement in related organisations.


The Fernandez-Cruz Foundation reserves the right to deny or withdraw Access to its site and/or services offered with no forewarning, on its own initiative or at a third party request, to users who fail to meet the current General Conditions of Use.


The Fernandez-Cruz Foundation shall pursue lack of compliance with current conditions as well as any undue use of its website by means of all manner of civil and penal actions that may be applicable under the law.


The Fernandez-Cruz Foundation can modify at any time the conditions set out here, being duly published as they appear here.

Said conditions will be in effect during the time they are displayed and will be valid until they are modified by other duly published conditions.

The relationship between the Fernandez-Cruz Foundation and the user will be governed by Spanish law in force and any dispute shall be submitted to the courts of the city of Madrid.
